Laboratories (MTVLabs) Certification Authority (CA), established under the authority of MTVLabs'
Principals, facilitates secure authentication of identity for both internal and external business
transactions. The MTVLabs CA is not a public CA. Certificates are only issued to MTVLabs, or to
customers, partners, and suppliers of MTVLabs, (hereafter known as Relying Parties.) MTVLabs Certificates are suitable for use with specific Public Key Infrastructure (PKI) implementations only, and should not be used or accepted for other purposes. Certificates may typically be used in conjunction with: • Allowing verification of digitally signed documents or transactions; • Authorizing network access; • Encrypting and signing e-mail, files, messages, and transactions. RELYING PARTIES OF MTVLABS ARE SOLELY RESPONSIBLE FOR DETERMINING THE SUITABILITY OF A CERTIFICATE FOR ANY GIVEN USE. THIS EVALUATION MUST BE DONE BY EACH RELYING PARTY AND IS NOT CONTROLLED SOLELY BY THIS DOCUMENT. A Relying Party assumes, without limitation, all risks and liability arising from any decision to rely on a Certificate if the Certificate cannot be validated as authentic and current, (not revoked.) Such authentication is often performed automatically through the internet -- but not always. If a Relying Party knows or has reason to know of any facts that would cause a person of ordinary business prudence to refrain from relying on a Certificate, they likewise must accept all risks and liability arising from any decision to rely on that Certificate. MTVLABS DISCLAIMS ANY AND ALL WARRANTIES, BOTH EXPRESS AND IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF ACCURACY OF INFORMATION PROVIDED WITH RESPECT TO THE RELYING PARTY'S PARTICIPATION IN THE MTVLABS CA, INCLUDING USE OF CERTIFICATES, DIGITAL SIGNATURES, KEY PAIRS, OR OTHER CA GOODS OR SERVICES PROVIDED TO A RELYING PARTY. MTVLABS DISCLAIMS ANY AND ALL WARRANTIES, BOTH EXPRESS AND IMPLIED INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF ACCURACY OF INFORMATION PROVIDED WITH RESPECT TO PRODUCTS OR SERVICES OF THE MTVLABS CA. IN NO EVENT SHALL MTVLABS BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF PROFITS, LOSS OF DATA, COST OF PROCUREMENT OF SUBSTITUTE SERVICES, OR ANY OTHER INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWSOEVER CAUSED, AND ON ANY THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), OR OTHERWISE. THESE LIMITATIONS WILL APPLY WHETHER OR NOT MTVLABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND WHETHER OR NOT MTVLABS COULD HAVE FORESEEN SUCH DAMAGES. |
